Notice of requirement for the designation of land at 32-44 Luke Street, Otahuhu
for a special school by the Ministry of Education. Auckland City Council gives notice
that it has received a requirement for a designation for public works under Section
168 of the Resource Management Act 1991. The requirement from the Ministry of Education
is for a designation to establish and operate a special school for students in years
1-13.
The work will include:
- the construction, undertaking, establishment, management, operation and
maintenance of purpose-built special school facilities
- every use of the land for educational purposes where the relevant education
authority constructs, undertakes, establishes, manages, operates or maintains
land for such work or use.
The proposed mitigation work and the land affected are identified on the plans
that accompany the notice of requirement. A full description of the work is set
out in the assessment of environmental effects (AEE) available at the places listed
below.

The notice of requirement, plans showing the precise extent of the requirement,
AEE and other background information may be inspected free of charge online or during
business hours at:
- level 11 of the Civic Administration Building, 1 Greys Avenue, central city
- the reference section of the Central City Library, 44-46 Lorne Street, central
city
- Otahuhu Community Library, 12 High Street, Otahuhu.
You must also serve a copy of your submission on the Ministry of Education (at
the address for service below) as soon as is reasonably practicable after serving
your submission on the council.

The process for public participation in the consideration of a proposed plan
modification under the act is as follows.
- After the closing date for submissions, the council must prepare a summary
of the submissions and this summary must be publicly notified.
- There must be an opportunity to make further submissions in support of,
or in opposition to, the submissions already made.
- If a person making a submission asks to be heard in support of his or her
submission, a hearing must be held.
- The council must give its decision on the proposal (including its reasons
for accepting or rejecting submissions).
- Any person who has made a submission has the right to appeal the decision
on the proposed plan modification to the Environment Court.
