How resource consents are affected
The Auckland City District Plan - Hauraki Gulf Islands Section 2006 ('proposed HGI 
plan') has effect from 18 September 2006 and must be complied 
with. 
Once the proposed HGI Plan has completed its statutory processes (i.e. 
submissions, hearings and appeals) it will be made operative and replace the
existing Plan which became operative in 1996.
It is important to be aware that during the transitional period, prior to the 
new Plan being made operative, both the operative HGI Plan (1996) and proposed 
HGI Plan (2006) must be taken into account.
This means that you must check any proposal for property development against both the 
proposed and the operative Plan. If either Plan requires a 
resource consent, 
you must obtain one before undertaking the activity.
When assessing resource consent applications, the council will consider 
both the existing and the proposed Plan. Case law gives guidance on the amount 
of influence or weighting to be given to a proposed Plan when assessing resource 
consents. The amount of weighting increases as the proposed Plan proceeds 
through the statutory stages of submissions, hearings, decisions and appeals. 
At the time of notification, less weighting is given to the proposed Plan than 
will occur later in the process.
